These Terms of Service (“Terms”) govern your use of the websites and services operated by Before Greatness LLC, a Colorado limited liability company (“Before Greatness,” “we,” “us,” or “our”), including beforegreatness.com, ephergent.com, and jeremyschroeder.net (collectively, the “Sites”).

By accessing or using our Sites, you agree to be bound by these Terms. If you do not agree, please discontinue use.

1. Purchases on ephergent.com

Physical Products

Return Policy: We accept returns of physical products within 30 days of delivery if the item is defective or damaged upon receipt. Items must be returned in their original packaging. Contact us at info@beforegreatness.com before returning any item.

Warranty: Physical products carry a 90-day limited warranty against manufacturing defects under normal use. This warranty does not cover damage caused by misuse, modification, or normal wear and tear.

Custom and Limited Edition Items: All sales of custom, limited edition, or made-to-order items are final. These items cannot be returned or refunded unless defective upon arrival.

Shipping: We ship from Colorado, USA. Shipping times are estimates and not guaranteed. We are not responsible for carrier delays.

Digital Products

Digital products (design files, STL files, software) are delivered electronically and are non-refundable once downloaded or accessed, except in cases of verifiable technical failure.

2. Digital Product Licenses

Personal Use License (Default)

All digital products purchased on ephergent.com are licensed for personal, non-commercial use only by default, unless otherwise stated at the time of purchase. You may:

  • Print or reproduce the files for personal use
  • Modify files for your own non-commercial projects

You may not:

  • Sell, redistribute, or sublicense the files
  • Use files in commercial products or services without a commercial license

Commercial Use License (Patreon Creator Tier)

Subscribers to the Patreon Creator Tier receive a commercial use license for digital products released during their active subscription period. This license permits:

  • Use in commercial products and for-sale items
  • Modification and derivative works for commercial use

The commercial license is non-transferable and terminates upon cancellation of the applicable Patreon tier.

3. Content on jeremyschroeder.net

All written content, photographs, videos, and other materials published on jeremyschroeder.net are the intellectual property of Jeremy Schroeder / Before Greatness LLC, unless otherwise attributed.

Fair Use: You may quote brief excerpts (up to 200 words) from articles for commentary, criticism, or educational purposes, provided you attribute the work with a link to the original page.

Prohibited Uses: You may not reproduce full articles, tutorials, or guides on other websites or publications without express written permission.

Open Source Code: Code snippets shared in tutorials may be used freely under the MIT License unless otherwise specified.

4. User Conduct

You agree not to:

  • Use our Sites for any unlawful purpose
  • Attempt to gain unauthorized access to any portion of our Sites or systems
  • Transmit spam, malware, or other harmful content
  • Scrape, harvest, or aggregate content from our Sites without permission

5. Third-Party Services

Our Sites integrate with third-party services (Stripe, Snipcart, Lemon Squeezy, Buttondown). Your use of those services is also subject to their respective terms. We are not responsible for the actions, content, or privacy practices of third-party services.

6. Disclaimer of Warranties

Our Sites and products are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • Our Sites will be available at all times or error-free
  • Any defects will be corrected
  • Our Sites are free of viruses or other harmful components

7. Limitation of Liability

To the fullest extent permitted by applicable law, Before Greatness LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use our Sites or products, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of our Sites shall not exceed the greater of (a) the amount you paid us in the 90 days preceding the claim, or (b) one hundred dollars ($100.00).

8. Indemnification

You agree to indemnify, defend, and hold harmless Before Greatness LLC and its members, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of our Sites, your violation of these Terms, or your infringement of any third-party rights.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of such courts.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Continued use of our Sites after changes constitutes acceptance of the revised Terms.
